Request for Expression of Interest (EOI) for 2018 Consultancy Projects

1.0 INTRODUCTION

The Nigerian Electricity Regulatory Commission (NERC) was established by the ESPR Act, 2005 to create, promote, and preserve efficient industry and market structures and to ensure the optimal utilization of resources for the provision of electricity services in Nigeria.

The Commission wishes to invite experienced and competent consultants to submit EOI for its first batch of 2018 Consultancies as stated in the table below:

 

 2.0 SCOPE OF SERVICE

LOT NO. PROJECT DESCRIPTION SCOPE OF SERVICES TO BE RENDERED SPECIFIC CRITERIA/QUALIFICATIONS
 1 Tariff Affordability Study in the Nigerian Electricity Supply Industry (NESI) Determination of the rate of affordability of the present tariff paid by consumers in all the 11 Electricity Distribution Companies (DisCos) i. Substantial in-depth experience in diagnosis, design, development and implementation of power sector reforms in developing countries
ii. Substantial in-depth experience in regulation of power sector, public and private participation, and market environment as well as experience in power market pricing including ancillary service pricing
iii. Experience in assisting other regulatory agencies in tariff setting and rate design 
 2 Valuation of Transmission Company of Nigeria (TCN) Assets Conduct of physical audit/verification and valuation of TCN’s assets in accordance with the prevailing Depreciated Optimised Replacement Cost (DORC) methodology applied in the operating Multi Year Tariff Order (MYTO) 2015 as approved by NERC  i. Specific experience of the consultant relevant to similar assignments with preference to projects of Regulatory Commission and Utility in Power Sector
ii. The Consultants shall be a firm or consortium of firms, lead staff of which should have substantial experience in the valuation of electricity transmission assets, financial modeling with strong background in regulated network utilities 
 3 Operational and Technical Audit of System and Market Operations in Nigeria Assessment of the current practices and procedures related to information exchange, economic dispatch, generation and interconnector scheduling, ancillary services, system reliability, registration of participants, metering, settlement, payment, compared to international practices, the market rules and Grid Code i. Reasonable experience in economic dispatch, generation scheduling, ancillary services and system reliability under the responsibility of System Operation and Market Operation functions in a restructured power sector.
ii. Relevant experience in the review and audit of system and market operations, grid metering, market settlement, balancing and market administration
 4 Engagement of Tender Auditor to audit the procurement of Meter Asset Providers (MAP) by the Distribution Licensees To audit the conduct and outcome of the procurement of Meter Asset Providers (MAP) by the Distribution Licensees, in line  with the MAP Regulations 2018, the Electric Power Sector Reform Act 2005 and other relevant regulations i. The auditor shall be a firm with a sound track record in conducting procurement audit of similar organizations in the energy industry or international/global organizations or public entities
ii. Knowledge and/or experience in competitive procurement policies, or other standards set forth for a specific procurement audit, are definitely an advantage
 5 Conceptual Design Of Nigerian Electricity Supply Industry (NESI) Data Aggregation Platform and Revenue Assurance System Design of a system to provide for the acquisition of real time data in respect of customer enumeration and new customer connection data, customer complaint tracking data, metering roll-out, prepayment meter vending, customer billing data, energy flow data, DISCO payment notification i. A firm or a consortium of firms with verifiable experience in systems design for electric utilities. The submission of evidence of such completed works is mandatory
ii. Specific experience of the consultants in designing similar IT infrastructure, preferably in the power industry and a strong understanding of the workings of the Nigerian Electricity Supply Industry

 

3.0 GENERAL ELIGIBILITY REQUIREMENTS
Interested and reputable firms should submit to submit two (2) bound EOI documents duly signed, paginated, separated by dividers and arranged in the order outlined hereunder:
a)    Evidence of Certificate of Incorporation with Corporate Affairs Commission (CAC) including CAC 2 and CAC 7;
b)    Evidence of firm’s Tax Clearance Certificates for the last three (3) years valid till 31st December, 2018;
c)    Evidence of current Pension Compliance Certificate valid till 31st December, 2018;
d)    Evidence of current Industrial Training Fund (ITF) Compliance Certificate valid till 31st December 2018;
e)    Evidence of current Nigeria Social Insurance Trust Fund (NSITF) Compliance Certificate valid till 31st December 2018;
f)    Evidence of up-to-date registration on the Database of Federal Contractors, Consultants and Service providers by submission of current Interim Registration Report (IRR) expiring on 1/1/2019 or valid Certificate issued by Bureau of Public Procurement (BPP);
g)    A Sworn Affidavit disclosing whether or not any officer of the relevant committees of the Nigerian Electricity Regulatory Commission or the Bureau of Public Procurement is a former or present director, shareholder or has any pecuniary interest in the bidder and to confirm that all information presented in its bid are true and correct in all particulars; and that the company is not in receivership or about to be in receivership or not a replacement for a hitherto tax defaulting company.
h)    Company’s Audited Accounts for the last three years (2015, 2016 and 2017);
i)    Evidence of financial capability to execute the project including Reference Letter from a reputable commercial bank indicating willingness to provide credit facility for the execution of the project when needed;
j)    Company profile with the Curriculum Vitae of Key Staff to be deployed for the project, including copies of their Academic/Professional qualifications;
k)    Verifiable documentary evidence of at least three (3) similar jobs executed in the last ten (10) years including Letters of Awards, Valuation Certificates, Job Completion Certificates and Photographs of the projects;
l)    For Joint Venture/Partnership, Memorandum of Understanding (MoU) should be provided (all the eligibility requirements are compulsory for each JV partner and foreign partners must meet requirements of their domiciled country);
m)    All documents for submission must be transmitted with a Covering/Forwarding letter under the Company/Firm’s Letter Head Paper bearing amongst others, the Registration Number (RC) as issued by the Corporate Affairs Commission (CAC), Contact Address, Telephone Number (preferably GSM No.) and e-mail address. The Letterhead Paper must bear the Names and Nationalities of the Directors of the Company at the bottom of the page, duly signed by authorised officer of the firm.
n)    Verifiable identification such as international passport bio-data page, national driver’s license, national identity card, permanent voter’s card of all directors.

4.0 SUBMISSION OF EOI DOCUMENTS
Interested firms are to submit two (2) bound of Expression of Interest (EoI) documents separated by dividers and arranged as indicated above. The documents should be submitted in a sealed envelope and addressed to:

Furthermore, the reverse of each sealed envelope should have the name and address of the bidder and dropped in the designated Tender Box located at the Commission’s Registry on the Ground floor not later than 12:00 noon Thursday May 31, 2018;

5.0 OPENING OF EOI DOCUMENTS
The Expression of Interest (EOI) documents will be opened immediately after the deadline for submission by 12:00 noon Thursday May 31, 2018 in the Commission’s hearing Room Wing B, 4th floor, Plot No. 1387, Cadastral Zone, A00, Central Business District, Abuja in the presence of bidders or their representatives. Please ensure that you sign the Bid Submission Register in the Commission’s Registry on the Ground floor, as the Nigerian Electricity Regulatory Commission will not be held liable for misplaced or wrongly submitted bids. 6.0 GENERAL INFORMATION
a. EoI must be in English Language and signed by an official authorised by the bidder;
b. EoI submitted after the deadline for submission would be returned un-opened;
c. Bidders should not express interest for more than two (2) LOTs
d. All costs will be borne by the bidders
e. All short-listed firms will be contacted at later date and issued Request for Proposals (RFPs).
f. The Commission is not bound to shortlist any consultant and reserves the right to annul the selection process at any time without incurring any liabilities in accordance with Section 28 of the Public Procurement Act, 2007.
